Probation Services Information

District Court Probation Services administers several categories:

District Court Probation Services charges fees ranging from $10 to $50 per month, depending upon the type of referral.

You Have Been Placed On a Type of Formal Supervision

The Court uses formal supervision to ensure completion of court requirements

Probation: The action of suspending the sentence of one convicted of a jailable offense and granting him or her provisional freedom on the promise of compliance and good behavior.

Deferred Prosecution: Defer- to put off until some future time. There is no conviction on your record. At the end of a successful completion of the treatment program and the supervised probation period, the charge will be dismissed.

You must call probation immediately for an intake appointment or further instructions if you reside outside Chelan County . Probation will mail to you a personal data form to be filled out and brought to your appointment. This intake appointment is mandatory. If you fail to make contact or fail to appear for the intake appointment, this could result in you serving your suspended jail sentence.

At the time of your appointment, your probation officer will review with you the sentencing and probation conditions. You will also sign a fee contract. If you cannot pay all or part of your probation fees, our fee waiver policy will be discussed. If it is necessary for you to receive treatment or counseling not provided by Probation, you will be referred to the appropriate outside agency at your own expense. You will be required to sign a release of confidential Information form.

Following a review of your past criminal history, your case will be classified according to risk. Your risk classification level will determine your reporting requirements and you will be so informed. Keep in mind that you are free to schedule an appointment to see your probation officer, even if you fall into a non reporting risk level.

Most probation appointments are scheduled for one-half hour. Walk-ins will not be seen. You must have a scheduled appointment.

Noncompliance in any form (new arrest, treatment failure, not keeping required probation appointments, unable to locate) is reported to the Court with a recommendation that you be removed from probation. This will result in a show cause hearing being scheduled. You must appear at this hearing before the Judge. Probation supervision is suspended until the Judge has decided what to do.

NOTE: Certain offenses require you to obtain court permission to apply to the Intersate Compact if you wish to return to your state of residence or relocate to another state. You MUST notify the Probation Department immediately and follow instructions. Leaving the State without official approval will result in a warrant for your arrest.

A Pre or Post Sentence Investigation Has Been Ordered

You need to report immediately to Probation in person unless you are incarcerated. An appointment will be scheduled for you to see a probation officer for an interview. (If you are in the Regional Jail, a probation officer will visit you there.) The appointment will last at least an hour. The incident and consequences of your arrest will be discussed, as well as the gathering of as much information as possible. Your criminal history and the arrest report will be reviewed. The Court, the Prosecutor, and your attorney will receive a detailed report which will contain recommendations suited to you. There is a $50 charge for this service.

If you reside out of Chelan County and cannot return for an appointment here, in most cases, your investigation can be transferred to another county.

You Have Been Ordered To Pay Restitution Through Probation Services

Restitution: The act of restoring, making good, or compensating for loss, damage, or injury.

Please call Probation Services immediately for further instructions. Probation will determine restitution in an adequate and fair way. Once an amount has been set, you will be contacted by mail and asked to schedule an appointment. A suitable payment plan will be discussed and a schedule of payments will be prepared. A copy of the plan will be sent to the victim. If there is any dispute about the amount of restitution, a hearing before the judge will be held. Any noncompliance, such as missed payments, or failure to make appointments, will result in a show cause hearing with the judge. This could result in all or a portion of the suspended jail sentence being imposed.

If you live out of the area, your restitution arrangements may possibly be handled by the mail or by telephone.

You Have Been Referred to Perform Community Service

Community Service: Work hours performed at a nonprofit organization for the betterment of the community.

Please call Probation Services for an appointment. If community service was ordered, the hours will have been set by the Court. If you have been ordered to work off fines, the hours will be figured by dividing the amount owed by the minimum wage rate. You will be assigned to a placement agency and given tracking calendars which will be utilized by your supervisor to report actual hours worked. You and your supervisor will arrange a suitable schedule of work hours. You will be expected to keep to your schedule and perform to the best of your ability. (Treat this as if it is a real paying job.) Any noncompliance will be reported to the Court for further disposition. You may be required to serve your suspended jail sentence or sit out your fines in jail.

If you reside out of Chelan County, it is possible to perform work at a nonprofit agency within your own county.
